Welcome to SocialBoothLV. These Terms of Service govern your use of our website and the booking of our photo booth rental and event decoration services. By submitting an inquiry, making a reservation, or using our services, you agree to be bound by these terms.

Please read these terms carefully before booking our services. If you do not agree with any part of these terms, please do not proceed with a reservation. These terms constitute a legally binding agreement between you (the "Client") and SocialBoothLV.

Services Overview

SocialBoothLV provides professional photo booth rental services and event decoration solutions primarily in the Las Vegas, Nevada metropolitan area. Our core services include 360-degree photo booth experiences that capture dynamic, shareable content; classic photo booths with instant printing capabilities and customizable digital overlays; professional balloon garland installations in custom colors and styles; and marquee letter rentals that spell out names, words, or phrases for your event backdrop.

In addition to our Las Vegas market, we also serve clients in Seattle, Washington and surrounding areas. Service availability, pricing, and equipment options may vary by location due to logistics and local market conditions. We recommend contacting us early in your planning process to confirm availability in your area and discuss any location-specific requirements.

All services are provided on a rental basis for the duration specified in your service agreement. Our team handles delivery, professional setup, on-site operation (when applicable), and breakdown of all equipment. Digital copies of all photos and videos captured during your event are included in your package and delivered via secure download link within 48-72 hours after your event concludes.

Booking and Reservations

To reserve your event date, we require a 50% deposit of the total service fee at the time of booking. Deposits can be paid via credit card, debit card, or bank transfer. Your date is not confirmed until we receive your deposit and you receive a written confirmation email from our team. We typically send booking confirmations within 48 hours of receiving your deposit, though during peak season (October through January) this may extend to 72 hours.

If you submit an inquiry or request a quote, we will hold your requested date for up to 7 calendar days from the date of our quote, giving you time to make a decision without pressure. After 7 days, if we have not received a deposit, the date hold expires and the date becomes available to other clients on a first-come, first-served basis. We recommend booking at least 4-6 weeks in advance for most events and 8-12 weeks for weddings or events during peak season.

The remaining 50% balance is due 14 days before your event date. We will send a payment reminder via email when your balance is due. If final payment is not received by the due date, we reserve the right to cancel your booking and retain your deposit. Once both deposit and final payment are received, your booking is fully confirmed and guaranteed.

Cancellation and Refund Policy

We understand that plans change, and we strive to be as flexible as possible while also protecting our business operations. If you need to cancel your booking 30 or more days before your event date, you will receive a full refund of all payments made, minus a $50 administrative processing fee to cover payment processing costs and staff time invested in your event planning.

For cancellations made between 14 and 30 days before your event date, you will receive a 50% refund of all payments made. This partial refund policy reflects the fact that we have likely turned down other bookings for your date and may not be able to fill the vacancy on short notice. Cancellations made less than 14 days before your event date are non-refundable, as we have committed equipment, staff, and logistics resources to your event.

Rescheduling is available at no charge if requested at least 21 days before your original event date, subject to equipment and staff availability on your new preferred date. Rescheduling requests made less than 21 days before your event will incur a $100 rescheduling fee to cover administrative costs and logistics changes. All refund requests must be submitted in writing via email to hello@socialboothlv.com and will be processed within 14 business days of approval.

Event Day Terms

For successful setup and operation, we require access to your event venue at least 1 hour before your contracted start time for photo booth services and 2 hours before for balloon installations or marquee letter setups. The venue must provide a standard 110V power outlet within 25 feet of the setup location. If power is not available at the desired location, you must notify us at least 7 days in advance so we can arrange a generator rental (additional fees apply).

Our 360 photo booth requires a minimum space of 10 feet by 10 feet with at least 8 feet of ceiling clearance for safe operation. Classic photo booths require 8 feet by 8 feet minimum. Balloon installations and marquee letters have varying space requirements depending on the specific design, which will be confirmed in your service agreement. All equipment must be set up indoors or in a covered outdoor area protected from direct sunlight, wind, and precipitation. Outdoor uncovered setups are not permitted as they risk equipment damage and safety hazards.

Your venue must allow our equipment and services. It is your responsibility to confirm with your venue that photo booths, balloon installations, and other décor are permitted and to obtain any necessary permissions or waivers. If we arrive at your venue and are denied access or permission to set up, this will be considered a client-caused cancellation and no refund will be issued. We recommend providing us with your venue contact information so we can coordinate directly if needed.

Intellectual Property

All photos and videos captured during your event using our photo booth equipment belong to you, the client. We provide digital copies of all content via a secure download link, and you are free to use, share, print, and distribute these images as you wish for personal, non-commercial purposes. We do not claim ownership of images containing your guests, and you may post them on social media, share them with attendees, or use them in personal albums without restriction.

SocialBoothLV retains the right to use select photos and videos from your event for marketing, advertising, portfolio, and promotional purposes on our website, social media channels, print materials, and other marketing efforts. This usage is subject to your consent, which we request at the time of booking. You may opt out of this marketing usage at any time by notifying us in writing. If you opt out, we will not use any images from your event publicly, though we may retain them internally for quality assurance and training purposes.

Custom digital overlays, branded templates, animation effects, and proprietary photo booth software interfaces created by SocialBoothLV remain our exclusive intellectual property. While you receive final rendered images that incorporate these elements, you do not acquire rights to the underlying templates, source files, or design assets. You may not recreate, reverse engineer, or commercially reproduce our custom overlay designs. Corporate clients requiring full intellectual property rights to custom designs must purchase an extended license (additional fees apply).

Liability Limitations

SocialBoothLV is not liable for circumstances beyond our reasonable control, including but not limited to venue-imposed restrictions we were not informed of in advance, venue power failures or electrical issues, acts of God such as severe weather or natural disasters, transportation delays due to traffic accidents or road closures, or equipment failure due to venue conditions (extreme heat, cold, humidity, or dust). In such cases, we will make reasonable efforts to provide alternative solutions, but if service cannot be delivered, our liability is limited to a full refund of payments made.

If our equipment is damaged by event guests due to misuse, horseplay, intentional damage, or failure to follow operator instructions, the client is responsible for repair or replacement costs. This includes but is not limited to: physical damage to photo booth hardware, spilled liquids on equipment, torn or stained backdrops, broken props, or damaged balloon installations. We will provide an itemized invoice for damages within 7 days of the event, and payment is due within 14 days. We carry liability insurance for accidental damage, but intentional or negligent damage by guests falls under client responsibility.

In any event, SocialBoothLV's total liability to the client, whether in contract, tort, or otherwise, shall not exceed the total service fees paid by the client for the specific event in question. We are not liable for indirect, incidental, consequential, or punitive damages including but not limited to lost profits, lost opportunities, emotional distress, or reputational harm. This limitation applies even if we have been advised of the possibility of such damages.

Indemnification

The client agrees to indemnify, defend, and hold harmless SocialBoothLV, its owners, employees, contractors, and affiliates from and against any and all third-party claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to the client's event. This includes claims by event guests for personal injury, property damage, or violation of privacy rights; claims by the venue for property damage or breach of venue policies; and claims by third parties for intellectual property infringement related to custom content requested by the client.

If a guest is injured while using our photo booth equipment due to their own negligence (such as tripping, falling, or collision while posing), or if guests engage in behavior that violates venue rules or local laws, the client accepts responsibility for managing their guests and assumes liability for such incidents. We maintain comprehensive general liability insurance, but this indemnification clause ensures that client-side issues remain the client's responsibility.

This indemnification obligation survives the termination of the service agreement and continues indefinitely for claims arising from the event date. The client must promptly notify SocialBoothLV of any claims covered by this indemnification and cooperate fully in the defense of such claims.

Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these terms or our services shall be brought exclusively in the state or federal courts located in Clark County, Nevada. By using our services, you consent to the personal jurisdiction of these courts and waive any objection to venue.

Before initiating any formal legal proceedings, both parties agree to engage in good faith negotiation to resolve the dispute. If a dispute arises, the complaining party must send written notice to the other party detailing the nature of the dispute. Both parties will then have 30 days to attempt to resolve the matter through direct communication. If negotiation fails, the parties agree to participate in mediation conducted by a neutral third-party mediator in Las Vegas, Nevada before proceeding to litigation. Mediation costs will be split equally between the parties.

Only after good faith negotiation and mediation have been exhausted may either party proceed to litigation in the courts specified above. The prevailing party in any litigation shall be entitled to recover reasonable attorney fees and costs. These dispute resolution terms do not prevent either party from seeking emergency injunctive relief in court if necessary to prevent immediate and irreparable harm.

Changes to Terms

SocialBoothLV reserves the right to modify these Terms of Service at any time to reflect changes in our business practices, legal requirements, or service offerings. When we make material changes that significantly affect client rights or obligations, we will provide at least 30 days advance notice by posting a prominent announcement on our website and sending email notifications to clients with upcoming bookings.

For clients with existing confirmed bookings at the time terms are changed, the previous version of the terms under which you booked will continue to apply to your specific event. New terms will apply to any future bookings made after the effective date of the change. You can always request a copy of the terms that were in effect at the time of your booking by contacting us.

Your continued use of our website or services after changes become effective constitutes your acceptance of the revised terms. If you do not agree with the changes, you must discontinue use of our services and, if you have an upcoming booking, you may cancel under the terms of the cancellation policy in effect at the time you booked.
